TERMS AND CONDITIONS FOR THE USE OF WEB HOSTING SERVICES AND CORPORATE EMAIL PLATFORMS
The acquisition of any plan, product, or service with Damos Soluciones S.A.S. and/or its legal representative implies the automatic acceptance of the terms and conditions set forth herein. Payment and contracting through electronic means or bank transfers also constitute acceptance of these terms, in accordance with Law 527 of 1999 on Electronic Commerce in Colombia.
From now on, the person contracting any of Damos Soluciones' services will be referred to as "The Client."
The use of the contracted services presumes acceptance of the following conditions:
1. Content
Services contracted with Damos Soluciones must be used exclusively for lawful purposes. It is strictly prohibited to use any contracted services that violate any local, national, or international law. While using the services, the Client shall not:
- Disseminate or transmit illegal, abusive, defamatory, racist, offensive, or objectionable information through photos, text, advertisements, or links to external pages.
- Publish, transmit, reproduce, distribute, or exploit any information or software containing viruses or other harmful components.
- Distribute pirated software or any material that violates intellectual property rights.
- Provide material or resources related to hacking, cracking, or any other activities deemed inappropriate by Damos Soluciones.
The following types of content are strictly prohibited on our servers:
- Defamatory or offensive material.
- Illegal adult content or pornography.
- Material related to hacking, cracking, key generators, serials, etc.
- Pirated software or content that infringes copyright.
- Programs or files that generate denial-of-service (DoS) attacks.
- Phishing sites or any activity related to fraud.
2. Security
The Client is prohibited from violating or attempting to violate the security of Damos Soluciones' servers, including but not limited to:
- Accessing data not intended for the Client or logging into a server or account for which the Client is not authorized.
- Attempting to test the vulnerability of a system or network or breaching security or authentication measures without proper authorization.
- Attempting to interfere with the service of any user, host, or network, including but not limited to sending viruses, overloading, flooding, spamming, mailbombing, or crashing.
Violations of system or network security may result in civil or criminal liability. Damos Soluciones will investigate incidents that may involve such violations and cooperate with authorities in prosecuting users involved in such activities.
3. Programs and Scripts
For hosting accounts with execution permissions, the Client may install and execute scripts as deemed necessary, provided they do not interfere with the server's normal operation, consume excessive resources, or affect other clients sharing the same server. Damos Soluciones reserves the right to disable any script or software that compromises the security or stability of its infrastructure.
4. File Distribution
Hosting plans are designed to host websites and not for the mass distribution of files. If the Client intends to use the account for storing large files or distributing software, videos, music, or other content, they must notify Damos Soluciones and contract an appropriate plan. Non-compliance with this rule may result in service suspension or termination.
5. Unsolicited Email (SPAM)
The sending of unsolicited email (SPAM) is strictly prohibited. This includes but is not limited to sending commercial advertising, promotional materials, charity campaigns, or petitions without prior consent from the recipient. Non-compliance with this policy will result in immediate service suspension and possible legal actions.
6. Backups
Damos Soluciones performs periodic backups of its servers. However, the availability and integrity of these backups are not guaranteed. It is the Client's responsibility to maintain updated backups of their hosted information. Damos Soluciones is not responsible for data loss, files, or any information hosted on its servers.
7. Payments and Deadlines
Service payments are made in advance according to the plan's specifications. It is the Client's responsibility to keep their contact information updated and monitor the service's expiration dates. Damos Soluciones will send expiration notifications, but it is not responsible for non-receipt due to spam filters, email address changes, or other reasons beyond its control.
8. Suspension and Termination of Service
Damos Soluciones reserves the right to suspend or terminate services if:
- The Client violates these terms and conditions.
- Payments for service renewal are not received within the specified deadlines.
In cases of suspension due to non-payment, the Client will have a grace period to regularize the situation. Failure to respond positively to notifications will result in the removal of the account from our servers, including all hosted information, such as files, databases, and email platforms.
9. Modifications
Damos Soluciones reserves the right to introduce changes to the features, prices, and terms of the offered plans and/or services. Any notification affecting technical service features will be made directly through our website or other appropriate means.
Additionally, Damos Soluciones reserves the right to update these terms and conditions periodically. Any changes will be notified to the Client at least 30 days in advance and will take effect after this period unless the Client decides to terminate the service before the changes come into effect.
10. Confidentiality
Damos Soluciones will maintain the confidentiality of the information provided by the Client for service payment, in accordance with data protection laws. We are committed to not sending advertisements without the Client's express consent and to protecting personal information against unauthorized access.
11. Limitation of Liability for Indirect Damages and Lost Profits
The Provider shall not be liable for indirect damages, including lost profits, reputational harm, or any economic loss arising from temporary or permanent service interruptions, whether due to technical failures, force majeure, unforeseen events, or circumstances beyond the Provider's reasonable control.
12. Dispute Resolution
Any dispute arising from these terms and conditions will be resolved through conciliation or arbitration, in accordance with mechanisms provided by Colombian law, before initiating any legal action. The Client and the Provider agree that these mechanisms are mandatory and must be exhausted before resorting to judicial proceedings.
13. Governing Law
These terms and conditions are governed by the laws of the Republic of Colombia. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
